Data protection declaration


Our core competency is the Swiss real estate sector. We take our customers seriously, especially their right to and need for data protection and data security. For this reason we decided to handle your data according to the European General Data Protection Regulation, even before the revised Swiss Data Protection Law becomes effective.

Data protection notice

This data protection notice has been in effect since 14 September 2020.

In their function as the responsible body, Kuoni Mueller & Partner and their group companies (consecutively called “KMP”) inform their users how their personal data will be processed, especially:

  • Personal data (such as e-mail-address, name, title, home address, phone numbers – consecutively mentioned as “data” or “personal data”), which are provided by the users when registering on the website (e.g. for contact requests and newsletter mailing);
  • Personal data which is transmitted from the user’s internet-browser every time they access our website, which is stored as a part of protocol data (known as server protocol data). This data includes: IP-address (internet protocol address) of the computer accessing the data; name of the page accessed; date and time of access; the URL from which users accessed the page; number of transmitted data; status report of successful access; and ID number of the browsing session.

The purpose of processing

As the responsible body, KMP disseminates personal data for the following purposes:

  • Performing requests by users (e.g. administer requests made by the contacts)
  • Sending relevant offers, information, and newsletters (e.g. administering orders by the users of regular electronic newsletters and information about real estate offers)
  • Enabling registering of the user on the website;
  • Technical administration of the website and their operative functions including solving technical problems, statistical analysis, tests and research;
  • Avoiding fraudulent activities or abuse on the website or connected to the website;
  • Complying with demands of the effective laws in order to protect the security of an individual and the rights and property of KMP, and avoiding deception or security and technical problems.

The legal basis of processing personal data is art. 6 I lit. a, b and f DSGVO (performance of a contract, agreement to direct advertising, authorised interest in sending relevant offers and information).

Nature of provision of personal data and the consequences of withdrawal

The provision of personal data by the user is voluntary. You can freely decide whether you want to provide KMP with your personal data, and you can subsequently withdraw your agreement to the processing of your personal data which you have already given. In certain circumstances, the withdrawal of your agreement means that you will not be able to use the website of KMP and that services cannot be provided. By providing your personal data you agree to us processing, storing, and using your data.

Method of processing

The processing of personal data of users follows only this data protection declaration and is done by: collecting, registering, organising, storing, advising, processing, changing, choosing, extracting, comparing, using, connecting, accessing and communicating, blocking, deleting and destroying data. The processing operation can be carried out either electronically or manually.

Accessing data

Personal data can be processed in detail by KMP by:

  • Employees and advisers who administer the website and who provide connecting services
  • Group associates of KMP
  • Third-party providers (e.g. IT service providers, hosting providers etc.) to which KMP has outsourced services with regards to carrying out operations within order processing.

Data disclosure

As the responsible body we can disclose your personal data. However, this information can only be given out for the following purposes:

  • For complying with legal obligations or obligations from regulations and guidelines of national or European legislation;
  • As defense in a legal action in a court of law.

Sharing of data

For the purpose of data processing we can transfer your data to our offer operators and group associates which can also be located abroad. If personal data is transferred abroad, we take the appropriate measures to ensure that personal data is also protected when used outside of Switzerland (appropriate data protection level in the respective country, using EU standard contracts). Furthermore, your data is shared only when performing a contracted obligation, and specifically your data is shared only with contract partners, notaries, and land registries.

Data storing

KMP stores personal data for the time necessary to reach the purposes for which the data has been collected and processed, including all retention periods which are necessary according to the effective law (e.g. in keeping accounting records).

Use of cookies

In order to improve searches of our website, KMP uses so-called cookies. Cookies are small text documents which usually consist of letters and numbers which are stored by the web-browser of users on their PC and contain pseudonymised data. Cookies enable a website to recognize the computer of the user and their browsing behaviour to identify users who return to the website. There are cookies for technical, analytical, and profiling purposes.

  • For storing the choice of measurements
  • For storing the last browsing requests
  • For storing the ID of the reminder list
  • For storing text allocation within AB-tests

Social media plug-ins

This website uses social media plug-ins which are provided by the largest social media networks (e.g. facebook and twitter). When visiting the website, browsing-data can be directly transferred to the related social network, even without direct interaction by the user. The user confirms and agrees that the social network plug-ins are directly administered by the company which provided the related plug-in. If users use the plug-ins over the website (e.g. by logging into a social media network with their credentials or connecting with their accounts), it means they have clicked on the button (e.g. “like” or “share” on facebook) and connected with the server of the related social media network which then transfers the content of the plug-in directly to the browser of the user.

In accordance with the terms of condition and data protection declarations, KMP can receive the data of the related social media network and can add to the personal data of users which have already been collected by our own services. If the users decide to share information on social media networks, they are also transferring data e.g. about their preferences, to KMP. In order to avoid that social media networks collect your personal data, please check the relevant conditions on the website of the social media network.

Rights of the individual user

You have a right to a full disclosure of the processing of your personal data (e.g. the origin of this data, the purpose of its processing, the modalities of data processing). Furthermore you are entitled at all times to disagree with the data processing for the future, to limit it, or demand its deletion. Finally you can stop at all times the transfer of advertisement material, market surveys or commercial information.
